1. Acceptance of Terms

Welcome to RapidClawAgent ("we," "our," or "us"). These Terms and Conditions ("Terms") govern your access to and use of our website https://rapidclawagent.com (the "Site"), our installer script, and any related services (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use our Services.

We reserve the right to modify these Terms at any time. Your continued use of the Services after any changes constitutes acceptance of the new Terms.

2. Description of Services

RapidClawAgent provides:

Installation Script: A one-command installer that deploys OpenClaw (an AI assistant framework) on your Virtual Private Server (VPS)
Configuration Presets: Pre-optimized settings designed to reduce API costs by 60-80%
Documentation: Guides and tutorials to help you set up and use OpenClaw
Support Resources: Email onboarding series, knowledge base, and chat support via our support bot

Important: RapidClawAgent is a deployment tool for OpenClaw, an open-source project. We do not own or maintain the OpenClaw software itself. For issues related to OpenClaw's core functionality, please refer to the official OpenClaw documentation or GitHub repository.

3. Eligibility

You must be at least 18 years of age to use our Services. By using the Services, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms.

If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

4. User Responsibilities

4.1 Account and Server Requirements

To use RapidClawAgent, you must:

Have access to a VPS running Ubuntu 20.04 or later (or a compatible Linux distribution)
Have root or sudo access to your server
Have an active internet connection on your server
Provide valid API keys for third-party services (e.g., Anthropic, OpenAI) as required by OpenClaw

4.2 Prohibited Uses

You agree not to use the Services to:

Violate any local, state, national, or international law or regulation
Infringe upon or violate our intellectual property rights or the rights of others
Transmit any harmful, malicious, or disruptive code (e.g., viruses, malware, worms)
Attempt to gain unauthorized access to our systems, servers, or networks
Use the Services to send spam, phishing emails, or unsolicited communications
Engage in any activity that could damage, disable, or impair the Services
Use the Services for any illegal, fraudulent, or abusive purpose
Reverse engineer, decompile, or disassemble any part of the Services (except as permitted by applicable law)
Resell, redistribute, or sublicense the Services without our express written consent

4.3 Compliance with Third-Party Terms

You are responsible for complying with the terms of service of any third-party services you integrate with OpenClaw, including but not limited to:

Anthropic (Claude API)
OpenAI (GPT API)
Google (Gemini API)
Your VPS provider (Hostinger, DigitalOcean, AWS, etc.)

Failure to comply with third-party terms may result in suspension or termination of those services, for which we are not responsible.

5. Intellectual Property Rights

5.1 Our Intellectual Property

The Site, the installer script, documentation, and all related content (including but not limited to text, graphics, logos, and design) are owned by us or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business purposes, subject to these Terms.

5.2 OpenClaw License

OpenClaw is an open-source project licensed under its own terms. Please refer to the OpenClaw GitHub repository for licensing details. RapidClawAgent does not alter or supersede the OpenClaw license.

5.3 User Content

If you provide feedback, suggestions, or other content to us (e.g., via email or chat), you grant us a worldwide, perpetual, irrevocable, royalty-free license to use, modify, and incorporate that content into our Services without any obligation to you.

6. Disclaimers and Limitations of Liability

6.1 "AS-IS" and "AS AVAILABLE" Basis

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

We do not warrant that:

The Services will be uninterrupted, secure, or error-free
The installer script will work on all server configurations
OpenClaw will function correctly after installation
Any defects or errors will be corrected
The Services will meet your specific requirements

6.2 No Responsibility for Third-Party Services

We are not responsible for:

The functionality, availability, or security of OpenClaw software (maintained by the OpenClaw project)
The performance or reliability of your VPS provider
API rate limits, costs, or service disruptions from third-party AI providers (Anthropic, OpenAI, Google, etc.)
Data loss, corruption, or breaches resulting from your server configuration or third-party services

6.3 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID TO US (IF ANY) IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR $100 USD, WHICHEVER IS LESS.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you.

7. Indemnification

You agree to indemnify, defend, and hold harmless RapidClawAgent, its affiliates, officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

Your use of the Services
Your violation of these Terms
Your violation of any third-party rights (including intellectual property or privacy rights)
Your violation of any applicable laws or regulations

8. Privacy and Data Protection

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information.

By using the Services, you consent to our collection and use of your information as described in the Privacy Policy.

9. Support and Maintenance

9.1 Support Channels

We provide support through:

Email Onboarding Series: 4 automated emails (Welcome, Day 3, Day 7, Day 14)
Knowledge Base: Self-service articles and FAQs available on our Site
Chat Support Bot: Automated support via our GoHighLevel chat widget
Email Support: support@rapidclawagent.com (best-effort response within 48-72 hours)

9.2 No Guaranteed Response Time

Support is provided on a best-effort basis. We do not guarantee response times or resolution of issues. For critical issues related to OpenClaw's core functionality, please refer to the official OpenClaw community or support channels.

9.3 Updates and Maintenance

We may update the installer script, documentation, or other components of the Services at any time without prior notice. We are not obligated to provide updates, patches, or bug fixes.

10. Termination

10.1 Termination by You

You may stop using the Services at any time by ceasing access to the Site and uninstalling any software you have deployed using our installer.

10.2 Termination by Us

We reserve the right to suspend or terminate your access to the Services at any time, with or without cause, and with or without notice, including if:

You violate these Terms
We suspect fraudulent, abusive, or illegal activity
We discontinue the Services (see Section 11)

10.3 Effect of Termination

Upon termination:

Your right to access and use the Services will immediately cease
We may delete any data or content associated with your account (except as required by law)
Sections 5, 6, 7, 10.3, 12, and 14 of these Terms will survive termination

11. Service Discontinuation

We reserve the right to discontinue, modify, or suspend the Services (in whole or in part) at any time, with or without notice, for any reason, including but not limited to:

Maintenance or technical issues
Changes in business strategy
Legal or regulatory requirements
Financial or operational considerations

We will make reasonable efforts to provide advance notice of any significant changes or discontinuation of the Services, but we are not obligated to do so.

We are not liable for any loss, damage, or inconvenience resulting from the discontinuation or modification of the Services.

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States of America and the State of Florida, without regard to its conflict of law principles.

12.2 Jurisdiction

You agree to submit to the exclusive jurisdiction of the courts located in Miami-Dade County, Florida, for the resolution of any disputes arising out of or related to these Terms or the Services.

12.3 Dispute Resolution Process

Before filing a lawsuit, you agree to attempt to resolve any dispute informally by contacting us at legal@rapidclawagent.com. We will attempt to resolve the dispute through good-faith negotiations within 30 days.

If the dispute cannot be resolved informally, either party may initiate binding arbitration or litigation as described in Section 12.2.

12.4 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You waive your right to participate in a class action lawsuit or class-wide arbitration.

13. Miscellaneous Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and RapidClawAgent regarding the Services and supersede all prior agreements, understandings, or communications, whether written or oral.

13.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions will continue in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of that right or provision.

13.4 Assignment

You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms at any time without notice.

13.5 No Agency Relationship

No agency, partnership, joint venture, or employment relationship is created between you and RapidClawAgent as a result of these Terms or your use of the Services.

13.6 Force Majeure

We will not be liable for any failure or delay in performing our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, government actions, pandemics, or internet outages.

13.7 Notices

All notices to you will be provided via email to the address you provided or by posting a notice on the Site. All notices to us should be sent to legal@rapidclawagent.com.

15. Acknowledgment
